What is this refund about? Is this a scam?

The Massachusetts Attorney General brought a case against Boston Sports Club and its former CEO, Patrick Walsh, for unfairly billing members during the COVID-19 pandemic for services that were not be provided, thwarting BSC members’ ability to cancel their memberships, and failing to honor cancellation requests.

In December 2024, the case was tried in Suffolk County Superior Court, and the Court ruled in favor of the Attorney General and the office’s claim that roughly 47,000 BSC members were unfairly billed and are entitled to a refund.

How was my refund amount determined?

Transaction data from BSC was used to identify which members were unfairly billed after their gym closed or they attempted to cancel their membership. This unfair billing was then offset by any amount already refunded by BSC to that member or value given via a credit to their account.

I submitted my claim. When can I expect to receive my payment?

Payments will be issued in multiple waves. You should receive payment within a few weeks of submitting your refund claim.

Why is the AGO using a Refund Administrator?

Because of the large number of consumers receiving refunds, the AGO hired Analytics LLC to issue refunds and answer questions. Analytics is the only administrator you should communicate with.

Our refund administrator will not charge a fee to file a claim or for any action related to this payment. Never provide any financial account numbers over the phone to anyone who calls you claiming to be our refund administrator.

Do I qualify for a refund?

Refunds were determined based on BSC transaction data, offset by any previous refunds or credits a member utilized.

I was a Boston Sports Club member. Why wasn’t I included?

The refunds are based on BSC transaction data verified at trial used to identify members who were unfairly billed in 2020 and who had not already been compensated. You may have already received a sufficient refund or credit. It is also possible that your claim was outside the scope of the trial, which focused on the COVID-19 pandemic from March to November 2020. Unfortunately, we cannot refund consumers beyond the list of members established by the Court.
